ich verstehe den Sachverhalt dieser Aussage aus dem Examiners Report nicht
It was expected that the client would be advised that the introduction of further dependent
claims is not allowable under Rule 80 EPC. However, it was often argued that further
dependent claims may be introduced as long as these do not violate Art 123(2) EPC. On
the other hand it was often argued that introducing such claims would in any event violate
Art. 123(2) or even Art. 123(3) EPC.
Reg. 80 sagt doch gerade, dass Änderungen möglich sind, wenn sie aufgrund von Einspruchsgründen angezeigt sind.
Und nach meinem Verständnis sind "neue" Unteransprüche sehr wohl möglich, solange ich den Schutzumfang nicht erweitere (Art. 123(3)) und dies von der ursprünglichen Offenbarung gedeckt ist (Art. 123 (2)).
